Summary:

Allegations of Dr. Guiang’s professional misconduct have been referred to the Ontario Physicians and Surgeons Discipline Tribunal.  It is alleged that in approximately 2011, Dr. Guiang engaged in sexual abuse of and/or engaged in disgraceful, dishonourable or unprofessional conduct towards Patient A, including but not limited to, engaging in oral to genital contact. It is further alleged that during medical appointments with Patient B, Dr. Guiang engaged in sexual abuse of and/or disgraceful, dishonourable or unprofessional conduct towards Patient B, including but not limited to engaging in touching of a sexual nature of Patient B’s genitals, including masturbation; masturbation in the presence of Patient B; and engaging in oral to genital contact. It is further alleged that during medical appointments with Patient C, Dr. Guiang engaged in sexual abuse of and/or disgraceful, dishonourable or unprofessional conduct towards Patient C, including but not limited to: engaging in touching of a sexual nature of Patient C’s genitals including masturbation; engaging in masturbation in the presence of Patient C; and engaging in oral to genital contact.

 As from November 23, 2023, the following are imposed as terms, conditions and limitations on the certificate of registration held by Dr. Charlie Bobby Guiang in accordance with an undertaking and consent given by Dr. Guiang to the College of Physicians and Surgeons of Ontario:

UNDERTAKING, ACKNOWLEDGEMENT AND CONSENT 
("Undertaking")

(the "College")

A.	PREAMBLE

(1)	In this Undertaking:
"Code" means the Health Professions Procedural Code, which is Schedule 2 to the Regulated Health Professions Act, 1991, S.O. 1991, c. 18, as amended; 

"Discipline Tribunal" means the Ontario Physicians and Surgeons Discipline Tribunal of the College;

"ICR Committee" means the Inquiries, Complaints and Reports Committee of the College;

"OHIP" means the Ontario Health Insurance Plan; 

"Ontario Physicians and Surgeons Discipline Tribunal" means the Discipline Committee established under the Code; and 

"Public Register" means the College's register that is available to the public. 

(2)	I, Dr. Guiang, certificate of registration number 75885, am a member of the College.  

(3)	I, Dr. Guiang, acknowledge that the College has received information regarding my alleged conduct and practice and that the College is conducting an investigation into that information, bearing File Number CAS-436974-T6Y0F4 (the "Investigation"). I am aware of the College's concern about protecting the public.

(4)	I, Dr. Guiang, acknowledge that the College has accepted this Undertaking in lieu of making an Order under section 25.4 of the Code at this time.

(5)	I, Dr. Guiang, acknowledge that this Undertaking does not preclude the ICR Committee from making an order at a later date in accordance with the Code.

(6)	I, Dr. Guiang, acknowledge that this Undertaking continues in force until the matters currently being investigated are disposed of by a panel of the ICR Committee or the Discipline Tribunal. 

B.	UNDERTAKING AND ACKNOWLEDGEMENT

(7)	I, Dr. Guiang, undertake to abide by the provisions of this Undertaking, effective immediately.

(8)	I, Dr. Guiang, undertake that I will not practise medicine in any jurisdiction until the following condition has been met:

(a)	I provide a minimum of forty-five (45) days written notice to the College of my intent to return to the practice of medicine.

(9)	I, Dr. Guiang, acknowledge that when it receives my request to return to practice, the ICR Committee will recommence its process of considering restrictions under s. 25.4 of the Code, and will reconvene to consider making an interim order restricting or suspending my practice under s. 25.4 of the Code.

(10)	I, Dr. Guiang, acknowledge that a breach of any provision of this Undertaking may constitute an act of professional misconduct and may result in a referral of specified allegations to the Discipline Tribunal.

(11)	I, Dr. Guiang, acknowledge that, in the event of a referral to the Discipline Tribunal and in the event of an appeal of any order of the Discipline Tribunal, if the Discipline Tribunal has directed the Registrar to revoke, suspend, or impose terms and conditions on my certificate of registration, that order will take effect immediately despite any appeal.

(12)	I, Dr. Guiang, acknowledge that all appendices attached to or referred to in this Undertaking form part of this Undertaking.

(13)	I, Dr. Guiang, acknowledge and undertake that I shall be solely responsible for payment of all fees, costs, charges, expenses, etc. arising from the implementation of any of the provisions of this Undertaking.

(14)	I, Dr. Guiang, acknowledge that I have read and understand the provisions of this Undertaking, and that I have obtained independent legal counsel in reviewing and executing this Undertaking, or have waived my right to do so.

(15)	I, Dr. Guiang, acknowledge that this Undertaking constitutes terms, conditions, and limitations on my certificate of registration for the purposes of section 23 of the Code. 

(16)	Public Register

(a)	I, Dr. Guiang, acknowledge that, during the time period that this Undertaking remains in effect, this Undertaking shall be posted on the Public Register.

(b)	I, Dr. Guiang, acknowledge that, in addition to this Undertaking being posted in accordance with section (16)(a) above, the following summary shall be posted on the Public Register during the time period that this Undertaking remains in effect:
The College has received information regarding Dr. Guiang's alleged conduct and practice and is conducting an investigation into that information. After receiving notice under s. 25.4 of the Code, Dr. Guiang voluntarily agreed that he will not practice medicine in any jurisdiction until and unless he provides a minimum of forty-five (45) days' written notice to the College of his intent to return to the practice of medicine, upon which the College may take interim action under s. 25.4 of the Code.

C.	CONSENT

(17)	I, Dr. Guiang, give my irrevocable consent to the College to make appropriate enquiries of OHIP and/or any person who or institution that may have relevant information, in order for the College to monitor my compliance with the provisions of this Undertaking.

(18)	I, Dr. Guiang, acknowledge that I have executed the OHIP consent form, attached hereto as Appendix "A".
