Summary of the Undertaking given by Dr. Gary Alan Rosenthal to the College of Physicians and Surgeons of Ontario, effective May 26, 2022:
The College has received a public complaint regarding Dr. Rosenthal’s conduct and is conducting an investigation into the information. During the investigation and in the event of a referral to the Discipline Tribunal:
Dr. Rosenthal must not engage in any professional encounters, in person or otherwise, with patients of any age, in any jurisdiction, unless the patient encounter takes place in the continuous presence of a monitor who is a regulated health professional approved by the College, and unless the other requirements provided in Dr. Rosenthal’s Undertaking with the College are fulfilled. For professional encounters occurring in an Operating Room or Endoscopy suite, a monitor who is a regulated health professional approved by the College must be present in the location to verify that Dr. Rosenthal is not alone at any time with any patient.
For further clarity, Dr. Rosenthal must not be alone with any patient during any professional encounter.
Dr. Rosenthal shall post a sign in all waiting rooms, examination rooms and consulting rooms, in his office Practice Locations, in a clearly visible and secure location, that states: “Dr. Rosenthal must not have professional encounters, in person or otherwise, with patients of any age, unless in the continuous presence of a practice monitor acceptable to the College of Physicians and Surgeons of Ontario. Dr. Rosenthal must not be alone with any patient during any professional encounter. Further information may be found on the College website at www.cpso.on.ca”. Dr. Rosenthal is not required to post a sign in the hospital setting.
